Welcome to cluttr. These Terms & Conditions (“Terms”) govern your use of our website and services. By registering, accessing, or using cluttr, you agree to these Terms.

 

1. About Cluttr

cluttr is an online resale marketplace based in Ajman, UAE. We provide a platform for individuals (“Sellers”) to list and sell pre-loved items, and for individuals (“Buyers”) to purchase those items.

cluttr does not own, manufacture, or guarantee the items listed on the platform. Responsibility for listing, describing, and delivering items lies with the Sellers.

 

2. Eligibility

You must be at least 18 years old to register as a Buyer or Seller

You must be a UAE resident to buy or sell on cluttr.

By creating an account, you confirm that the information you provide is accurate and complete

 

3. Seller Responsibilities 

Sellers agree to:

  • Provide accurate descriptions, including condition, size, defects, and truthful photos

  • Ensure items are clean, safe, and legal to sell in the UAE

  • Mark items as “Fulfilled” in the seller dashboard once they are ready for pickup

  • Make items available within 24 hours of sale unless otherwise arranged

  • Leave items at the door or with building security for overnight pickup (or specify alternative timing in the Fulfillment Note)

 

cluttr reserves the right to suspend Sellers after repeated issues, including but not limited to:

• inaccurate descriptions

• defective items

• delays in fulfilment

• multiple complaints from Buyers (more than two)

 

4. Buyer Responsibilities

Buyers agree to:

  • Provide accurate delivery information

  • Ensure building access for delivery (door or security)

  • Report any issue within 48 hours of delivery

Returns are only accepted for:

• major undisclosed defects

• items not matching description or photos

 

Returns are not accepted for change of mind, size/fit issues, or normal wear.

 

5. Commission & Fees

cluttr charges a flat 15% commission per sale, unless otherwise specified. 

Sellers will see commission deducted before payout.

No hidden fees apply.

 

6. Payments

Payments are processed securely via Paymob, cluttr’s approved payment gateway.

  • cluttr holds the Buyer’s payment for 72 hours after delivery

  • If no issue is reported within 48 hours, the funds are released to the Seller’s cluttr Wallet

  • cluttr is not responsible for delays caused by banks or third-party processor

Seller Payouts

Sellers may:

  1. Request a payout to their bank account via the cluttr Wallet page, or

  2. Use their balance to shop on cluttr (partial or full use subject to wallet balance)

Payout requests are processed manually. Sellers must ensure their bank details are accurate.

 

7. Delivery & Pickup

cluttr currently assists with local pickup and delivery within Dubai

 

Pickup Process

  • Sellers are notified by email when an item sells

  • Sellers must mark the order as “Fulfilled” when the item is ready

  • Standard pickup occurs overnight

  • Sellers must leave items at their door or with building security

  • If overnight pickup is not possible, Sellers must note this in the Fulfillment Note for daytime pickup (9am–5pm)

 

Delivery Timeline

Buyers typically receive all items within 1–2 business days after pickup.

cluttr is not responsible for items lost or damaged due to building access issues or Seller packaging errors.

 

8. Returns & Refunds

 Returns are only accepted if the item has a major defect, or if it does not match the description or photos provided by the Seller

Returns are not accepted for change of mind, wrong size or fit, or normal wear and tear

Buyers must report any issue within 48 hours of delivery

If a return is approved, the item must be returned to the Seller in the same condition it was received. A full refund will be issued to the Buyer once the Seller confirms receipt

Sellers who repeatedly list inaccurate or faulty items may be suspended

 

9. Prohibited Items

You may not list or sell the following

Counterfeit or stolen goods

Weapons or hazardous materials

Food, cosmetics, or personal care products

Items prohibited by UAE law

 

10. Disputes

Buyers must report disputes within 48 hours of delivery

cluttr may mediate disputes but does not guarantee resolution

If unresolved, disputes are subject to UAE law and the jurisdiction of Ajman courts

 

11. Intellectual Property

All content on cluttr (logo, branding, website design) is owned by cluttr and may not be copied without permission

Sellers are responsible for ensuring their listings do not infringe intellectual property rights

 

12. Limitation of Liability

cluttr provides the platform “as is,” without warranties

cluttr is not liable for the quality, safety, legality, or accuracy of items listed

cluttr's liability to any user shall not exceed the total commission fees paid by that user in the past 6 months

 

13. Changes to Terms

We may update these Terms from time to time. Continued use of cluttr constitutes acceptance of the revised Terms
